Privacy Notice
The privacy of the owner of the personal data, as well as the confidence of the owner, are issues of great importance to the Swiss-Mexican Chamber of Commerce and Industry A.C. – SwissCham Mexico. For this reason, we make sure that the owners know how we protect and safeguard the privacy and integrity of their personal data, in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, and its Regulations.
For the Cámara Suizo-Mexicana de Comercio e Industria A.C., it is essential to collect some personal data, so it reiterates its legal and social commitment to comply with legal and security measures to protect the data collected.
By virtue of the foregoing, we recommend reading this Privacy Notice:
- The holder of the personal data (the “ Data Subject “) expresses his/her consent to this Privacy Notice by clicking on the corresponding box indicating “aware and in agreement” at the end of this Privacy Notice. The Data Subject expressly authorizes the CÁMARA SUIZO-MEXICANA DE COMERCIO E INDUSTRIA, A.C. (the “Data Subject”) to disclose personal information about him/her in accordance with the terms of this Privacy Notice. Responsible(hereinafter each and every one of these activities collectively referred to as the “…”) to carry out the procurement, access, use, exploitation, disclosure, transfer, disposal and/or storage (hereinafter each and every one of these activities collectively referred to as the “…”).TreatmentThe information provided by the Registrant (hereinafter collectively referred to as the “) of general, legal, accounting, financial and asset information, as well as the Registrant’s personal data, such as full name, address, telephone numbers, e-mail address, date of birth, payment method information, CURP and RFC (hereinafter collectively referred to as the “) of the Registrant, as well as the Registrant’s personal data (hereinafter collectively referred to as the “) of the Registrant.Personal Data), obtained through our website: http://www.swisscham.mx and/or e-mails with domain: @swisscham.mx and/or any other form, in the understanding that in no case is it requested to include “sensitive personal data” [as such term is defined in the Federal Law for the Protection of Personal Data in Possession of Individuals (the “Law”).Law“)].
- The Controller is obliged to ensure that the Processing of the Personal Data of the Data Subject is in compliance with the provisions of the Law, the Mexican legislation and international law. Additionally, the Processing of the Personal Data of the Data Subject is subject to all of the following:
2.1 Revocation of consent. Except as otherwise provided by law, the authorization for the Processing of Personal Data shall be revocable at any time by the Data Subject in accordance with the procedure set forth in section 2.7 below.
2.2 Purposes. The Processing of Personal Data will be carried out for the following original and necessary purposes: (i) the promotion, defense, advice, promotion and encouragement of commercial relations between Mexico and Switzerland; (ii) the representation, promotion and defense of the interests of its affiliates; (iii) the provision of services and the granting of benefits to its affiliates; and (iv) the coordination of communication among its affiliates. Likewise, the Processing of Personal Data may also have the following non-necessary purposes: (i) to evaluate the quality of products and/or services; (ii) to comply with the obligations contracted with the Holder; (iii) to create tax receipts, such as invoices, credit or debit notes; (iv) to send information, letters and communications; (v) to prepare reports for authorities; (vi) to prepare monitoring, evaluations and statistics; and (vii) for marketing, advertising or commercial prospecting purposes.
2.3 Transfers. The Data Subject agrees to the transfer, national and international, of his or her Personal Data in accordance with this Privacy Notice. The Controller will take the necessary and sufficient measures to ensure that this Privacy Notice is respected at all times by the Controller or the third parties that receive it.
2.4 Temporality. The Processing of Personal Data shall be carried out for as long as necessary for the Controller and/or the Data Subject to fully comply with their respective obligations and for the additional time provided for in accordance with the applicable legal provisions.
2.5 Controller. The Processing of Personal Data will be carried out solely and exclusively by the following persons: the Controller, its administrators, managers, employees and attorneys-in-fact, consultants and representatives, as well as its affiliates.
2.6 Confidentiality. It is established that the Personal Data constitutes confidential information of the Data Subject. Therefore, the Controller agrees to keep each and every one of the Personal Data in strict confidentiality and undertakes not to disclose or reveal the Personal Data to persons other than those indicated above without the prior written consent of the Data Subject. The confidentiality obligation shall not apply to: (i) information that is in the public domain, that is public or that is contained in Public Access Sources as such term is defined in the Law; (ii) information that is obvious, including to a technician in the matter; (iii) information that prior to its disclosure is already in the possession of the Controller or any of the persons referred to in the preceding paragraph or has been developed independently by the Controller or by such persons; or (iv) information that must be disclosed by legal provision, court order or competent authority. Likewise, the Data Subject is informed that the Controller has adopted security measures for the protection of Personal Data, including measures to prevent the loss, misuse, alteration, unauthorized access or theft of Personal Data, such as data encryption and passwords.
2.7 ARCO Rights. It is established that the Personal Data Owner shall have the right of access, rectification, cancellation or opposition in accordance with the provisions of the Law. To enforce these rights, as well as the right to revoke consent, the Personal Data Subject shall follow the procedure described below:
- The request for access, rectification, cancellation or opposition, as well as the revocation of consent, must be made in writing and addressed to the Swiss-Mexican Chamber of Commerce AC, with address at Lago Alberto 319, Piso 12,
Granada, Delegación Miguel Hidalgo, C.P. 11320 Mexico City, Mexico; telephone: + 52 (55) 5003 9790, Internet address: http://www.swisscham.mx and e-mail info@swisscham.mx. - The request must contain and be accompanied by the following: (i) the name of the Data Subject and address or other means to communicate the response to the request; (ii) the documents proving the identity or, if applicable, the legal representation of the Data Subject; (iii) a clear and precise description of the Personal Data with respect to which the exercise of any of the aforementioned rights is sought; (iv) any other element or document that facilitates the location of the Personal Data; (v) if applicable, the modifications to be made and provide the documentation supporting the request.
- The Controller will communicate to the Data Subject, within a maximum period of 20 (twenty) business days from the date on which it received the corresponding duly integrated request, the determination adopted, so that, if appropriate, the same becomes effective within 15 (fifteen) business days following the date on which the response is communicated to the Data Subject. In accordance with the provisions of the Law, the aforementioned terms may be extended only once for an equal period of time, provided that the circumstances of the case so justify.
- The fact that the Data Subject expresses his/her opposition to the Processing of his/her Personal Data shall not be a reason for the Controller to deny the products and/or services offered and/or contracted.
- This Privacy Notice may be modified by means of a simple written notice sent by the Controller to the Personal Data Holder or by publishing the corresponding modification on our website http://www.swisscham.mx at least 30 (thirty) calendar days prior to the effective date of the modification. In the event that the holder of the Personal Data does not agree with the modifications, he/she will have the right to object under the terms of paragraph 2.7 above. If no objection is filed during the 30 (thirty) calendar days indicated above or if the objection is unfounded, the modifications to this Privacy Notice shall be deemed accepted for all legal purposes. The above procedure will not be necessary when the modifications are contained in a written agreement signed by the Personal Data Holder.
The Data Subject consents to and accepts this Privacy Notice.
